Scope and Content • Letter dated 8 October 2008 from Michala Clifford, Senior HR Manager, Health and Social Services to Witness 7. Copy sent to Mr M Pollard (Chief Officer, Health and Social Services). Refers to Witness 7's return to his substantive post at the Children's Service and advises Witness 7 of the decision that his suspension from work on full pay should be extended whilst he remains the subject of investigations by the Police in connection with allegations made against associated with the ongoing historical abuse case following a formal review of the suspension by the Chief Officer of Health and Social Services and the Treasurer of the States. Reminds Witness 7 that he must not enter States of Jersey premises without the permission of Mike Pollard or Richard Jouault, and notifies him of a further review to take place in a month's time. • Letter dated 6 October 2008 from D Warcup, Deputy Chief Officer, States of Jersey Police to Mr M Pollard, Head of Health and Social Services. Refers to information that has come to the attention of the States of Jersey Police regarding Witness 7, referring to common law power of the Police to disclose information where a duty to protect the public or to investigate and detect crime outweighs the duty of confidence which the police owe to individuals who assist them with enquiries. States that the information provided is used solely to determine the suitability for continuing employment in a position of trust working with vulnerable children, stating that the information given must be treated in the strictest confidence and that notice of the letter is to be delivered to Witness 7. Stresses that Witness 7 has not been charged with any criminal offences and remain a person who has not been convicted or cautioned. Provides details of allegations of physical and sexual abuse made by former residents of Haut de la Garenne and La Préférence against Witness 7. Refers to material being found following searches at Witness 7's home address that is subject of further enquiries and notes that Witness 7 made no comment replies to all questions asked to him in interview. Notes that enquiries continue into allegations concerning Witness 7 which may require him to be interviewed further and reiterates that Witness 7 has not been charged and the matter not been tested by a court. • Letter dated 9 September 2008 from Ian Crich, Director of Human Resources, Chief Minister's Department to Witness 7. Copies sent to Mr I Black (Treasurer of the States), Mr M Pollard (Chief Officer, Health and Social Services) and Mrs S Cuming (Senior HR Manager). Advises Witness 7 of the decision that his suspension from work on full pay should remain in place whilst he remains the subject of investigations by the Police in connection with serious crimes associated with the ongoing historical abuse case following a formal review of the suspension by the Chief Officer of Health and Social Services and the Treasurer of the States. Reminds Witness 7 that he must not enter States of Jersey premises without the permission of Mike Pollard or Ian Black, and notifies him of a further review to take place in a month's time.
