Scope and Content

Refers to Witness 4's godfather contacting Detective Constable Rachel Hart of the Historical Abuse Team on 4 December 2007 stating that Witness had disclosed to him that he had been sexually abused by a named male staff member whilst residing at [a residential respite centre]. Refers to subsequent contact from Witness 4's stepmother about Witness 4's discloure in 2002 that he had been sexually assaulted by the male staff member, noting awareness that matter had been investigated by Police, enquiring whether the matter could be re-examined within the parameters of the investigation into historical institutional child abuse. Gives details of research into the original investigation carried out by the States of Jersey Police in 2002, noting Witness 4's residence at the [residential respite centre], and disclosure by Witness 4 of sexual abuse by the male staff member after being questioned by his father and stepmother about an incident whereby Witness 4 and another male resident had engaged in sexual activity. Refers to Witness 4's father contacting the Police and subsequent statements obtained from Witness 4's father and stepmother by the Family Protection Unit, and disclosure by Witness 4 in a video interview of sexual abuse by the male staff member towards three male residents including Witness 4, noting lack of identification of the man. Notes contact with the other male residents named by Witness 4 resulted in no disclosures of abuse, and identification of a possible suspect by the Family Protection Unit. Notes that the suspect provided a no comment interview on 10 June 2002, and consequently no charges were brought against him due to insufficient evidence. Notes tha tenquiries made thereafter with regards to The Children's Service failed to provide additional evidence in relation to Witness 4's disclosure, and closure of the case following consultation with legal advisors. Refers to contact made by members of Witness 4's family in December 2007 regarding the possibility of reinvestigating the disclosures of abuse made by Witness 4 within parameters of [Operation Rectangle]. Refers to the Department and Social Services being approached on 20 May 2008 by Witness 4's father and stepmother questing to use influence to have Witness 4's complaints against the male staff member reinvestigated. Refers to Detective Constable Monaghan and Detective Sergeant David Hill subsequently speaking to Witness 4 and Witness 4's father and stepmother about there being insufficient evidence to re-examine the matter, and action taken to help Witness 4 understand why no prosecution had been brought against the male staff member. Provides opinion that the case contains no further evidence that may be of benefit to Operation Rectangle.
